Key Changes Introduced
  1. Restriction on Import of ATS-8
    • Import of ATS-8 {(4R-Cis)-1,1-Dimethylethyl-6-cyanomethyl-2,2-dimethyl-1-3-dioxane-4-acetate} with a CIF value below US$111 per kg is now classified as ‘Restricted’.
    • This restriction will remain in place till 30th September 2026.
  2. Exemption from MIP Condition
The Minimum Import Price (MIP) condition shall not apply to imports made by:
    • Advance Authorization holders
    • Export Oriented Units (EOUs)
    • Units located in Special Economic Zones (SEZs)

However, this exemption is subject to the condition that imported inputs must not be sold into the Domestic Tariff Area (DTA).

Effect of the Notification
  • Introduces stricter control on low-value imports of ATS-8 to regulate quality and safeguard domestic interests.
  • Provides relief to export-linked entities (AA/EOU/SEZ) by exempting them from the MIP condition, ensuring smooth availability of critical inputs for export production.
  • Aligns import policy with the broader goals of trade facilitation and domestic industry protection.
Conclusion

The amendment strikes a balance between restricting low-value imports of ATS-8 and facilitating exporters with necessary exemptions. Stakeholders, particularly exporters and importers in the chemical sector, should take note of this change to ensure compliance with the updated import policy framework.
